Are you seeking to legally establish a parent-child relationship in Vietnam involving a foreign national?
Vietnam National Law provides legal assistance to Vietnamese citizens and foreign nationals with parent-child relationship registration procedures, helping clients prepare the required documents and complete the application process in accordance with Vietnamese law.
1. Required Documents
Depending on the circumstances, the required documents may include:
- Valid Passports or Identification Documents:For all parties involved. A VNeID Level 2 account may be required for the Vietnamese parent.
- Address Information:Details of the current addresses of the parties.
- Evidence of the Parent-Child Relationship:Such as DNA test results or other legally accepted evidence.
- Written Declaration and Witness Statements:If documentary evidence is unavailable, the parties may need to submit a written declaration acknowledging the parent-child relationship, together with statements from at least two witnesses confirming the relationship.
- Child’s Birth Certificate:If available.
Note: Based on our experience, DNA test results can provide straightforward evidence of the parent-child relationship for consideration by the competent authority. The authority will determine whether the submitted evidence satisfies the applicable legal requirements.
The exact document requirements depend on the parties’ nationalities, the child’s circumstances and the competent authority.
(*) Important Note: The foreign-issued document must be apostilled or consularly legalized, where applicable, before being translated into Vietnamese and notarized/certified in Vietnam. Vietnam National Law also provides assistance with Apostille, consular legalization, Vietnamese translation and notarization procedures.
