CONDITIONS FOR AN IMMIGRANT TO BY/OWN A HOUSE
1. The immigrant must have a passport or relevent documents which can replace the passport and are issued by foreign authorized agencies and accompanied by one of these documents:
- In case the immigrant is an direct investor in Vietnam, he/she must have an investment certificate or relevent documents which have more than 1 year to the expiry date or documents which prove he/she is the member of Board of Directors of a company operating in Vietnam.
- In case the immigrant is work as a manager for a business operating in Vietnam, he/she must have the employment contract or the decision appoint written in Vietnamese.
- In case the immigrant is a person with meterious services to Vietnam, he/she must have a medal awarded by the President of the Socialist Republic of Vietnam. If he/she has made special contributions to the country, he/she must have a certificate issued by an authorized agency and sent to relevent departments and the Prime Minister for being reviewed.
- In case the immigrant is working in fields including economics, science, technology, environment, education & training..., he/she must have a degree to prove his/her professional which is issued by an authorized agency. The degree must be accompanied by a work permit or a license to practice in the field of his/her specialization issued by an authorized agency in Vietnam.
- In case the immigrant has a special skill, he/she must have documents to certify his skills and professionalism issued by the Professional Association of Vietnam, which is accompanied by a work permit or a license to practice in the field of his/her specialization issued by an authorized agency in Vietnam.
- In case the immigrant has married a Vietnamese citizen, he/she must have a Certificate of Marriage issued by an authorized agency in Vietnam or in foreign country, which is accompanied by a permanent residence and identity card of the Vietnamese citizen
The immigrant in all cases above must have a resident card or a temporary residence card or documents to prove he/she can reside in Vietnam for more than 12 years.
2. The house to be bought or owned by an individual or must be an apartment or a house(villa or townhouse) of commercial housing development projects and must not be in restricted areas.
REQUIRED DOCUMENTS
1. An application for certicifate of house ownership and land ownership written in Vietnamese & English ad in the prescribed form.
2. Documents of ownership of the seller:
a) In case of an apartment of a commercial housing development project operated by a real estate company (This case is applicable when the apartment is completely constructed at present or will be completely constructed in the future):
- A written decision apporving the commercial housing development project from a authorized agency.
- The land lease contract or the written decisions on allocation or the certificate of land use rights issued by an authorized agency.
- The drawing of the floor plan of the apartment.
- The apartment delivery record accompanied by the record of provisions of managing and using the condomunium issued by the (seller) company. (required when when the apartment is completely constructed and ready for sale at present)
b) In case of an apartment of a commercial housing development project operated by an individual:
- The certicifate of house ownership and land ownership under the provisions of the Housing Law and the Decree No. 60/CP on July 5th 1994 of house ownership and urban land ownership or the certicifate of house ownership and land ownership under the provisions of the Housing Law and the Decree No. 95/2005/NĐ-CP on July 15th 2005 of issusing certificate of house ownership and construction ownership.
- The certificate of land ownership which indicate the house on the land issued under the provisions of the Land Law 2003.
3. The original contract of house buying, selling or giving or documents of inhereting the house under the provisions of the Law of Vietnam.
4. A certified copy of the passport and one of the document stipulated under item a, b, c, d, e.
5. Documents issued by Property Exchange certifying that the apartment has been traded through the Exchange under the provisions of the law of real estate business (in case the apartment is bought from a real estate company).
6. Receipts of tax and registration fees under the provision of the state law.
